Home Maintenance Packages – Terms and Conditions
1. Scope of Services
By enrolling in the Proactive Home Maintenance Program, the Client authorizes DLUXE CONSTRUCTION LLC to provide routine inspection, maintenance, and repair services as specified in the selected maintenance plan. The scope of services will include but is not limited to, preventive check-ups, minor repairs, and maintenance tasks necessary to ensure the property’s optimal condition.
2. Service Schedule and Access
Maintenance visits will be scheduled according to the frequency outlined in the chosen plan (monthly, quarterly, etc.). The Client agrees to provide necessary access to the property for DLUXE CONSTRUCTION LLC to perform scheduled maintenance, either by coordinating entry at the agreed time or by granting access through approved means.
3. Additional Services and Authorizations
Any additional repairs or services outside the scope of the selected maintenance plan will require the Client’s prior written approval. Additional charges may apply for any services outside the scope, which will be agreed upon by the Client before the work is completed.
4. Payment Terms
The Client agrees to make payments as outlined in the selected maintenance plan. Payment for each service period (monthly, quarterly, or annually) will be due on the first day of the service period. Failure to make timely payments may result in suspension or cancellation of services.
5. Automatic Renewal and Termination
Unless canceled in writing at least 30 days before the end of the current term, the maintenance plan will automatically renew for the same duration as the initial term. The Client may terminate the plan by providing written notice. Termination will take effect at the end of the current billing cycle, and no refunds will be provided for unused services.
6. Cancellation and Refund Policy
The Client may cancel their maintenance plan within 14 days of the initial service without penalty, subject to a prorated refund for services already performed. After this period, all sales are final, and refunds will not be provided for any remaining portion of the service term.
7. Liability and Warranty
DLUXE CONSTRUCTION LLC will exercise reasonable care in performing all services. However, the Client agrees to release DLUXE CONSTRUCTION LLC from liability for damages or issues arising from normal wear and tear, pre-existing conditions, or damages outside the scope of the maintenance plan.
8. Client Responsibilities
The Client agrees to notify DLUXE CONSTRUCTION LLC promptly of any observed maintenance issues or defects and will not undertake repairs themselves for items covered under this contract without prior approval. Failure to report problems may affect the scope and coverage of this maintenance plan.
9. Changes to Services or Terms
DLUXE CONSTRUCTION LLC reserves the right to modify the scope of services, service schedules, or contract terms. Clients will be notified in writing of any changes at least 30 days before they take effect. Continuing with the maintenance plan after changes have been communicated will constitute acceptance of the updated terms.
10. Governing Law
This agreement shall be governed by the laws of Portland/Oregon, and any disputes arising from this agreement shall be resolved through arbitration in Portland unless otherwise agreed by both parties.
